1. Acceptance of Terms

Welcome to InstantIQ. By accessing or using our Chrome browser extension and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and InstantIQ ("we," "our," or "us"). We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Service Description

InstantIQ is an AI-powered Chrome extension that provides assistance with quiz questions, homework problems, and academic content. Our Service uses advanced artificial intelligence models (including GPT-4 Vision and Claude 3.5 Sonnet) to analyze questions and provide answers, explanations, translations, calculations, and other academic assistance.

The Service includes various features and request types:

• Solve: Get direct answers to questions
• Explain: Receive detailed explanations of concepts
• Translate: Convert text between languages
• Calculate: Solve mathematical problems
• Extract: Pull key information from text
• Rewrite: Rephrase or restructure content

3. User Accounts and Registration

To use InstantIQ, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring your account information remains accurate and up-to-date

You must be at least 13 years old to create an account. If you are under 18, you represent that you have permission from a parent or guardian to use the Service.

4. Subscription Plans and Billing

• We reserve the right to change pricing with 30 days' notice to existing subscribers

4.3 Cancellation and Refunds

You may cancel your subscription at any time through the extension settings or by contacting support at support@instantiq.app. Upon cancellation:

• You will retain access to paid features until the end of your billing period
• Your account will automatically downgrade to the free tier
• No refunds will be issued for partial billing periods
• You may resubscribe at any time

5. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Engage in academic dishonesty or violate your institution's honor code
• Resell, redistribute, or share your account access with others
• Attempt to reverse engineer, decompile, or hack the Service
• Use automated tools (bots, scrapers) to access the Service without permission
• Submit malicious content, spam, or content that violates intellectual property rights
• Overload or interfere with the proper functioning of the Service
• Use the Service in a way that could harm InstantIQ or its users

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.

6. Academic Integrity and Responsible Use

InstantIQ is intended as a learning and study aid. We encourage responsible use that supports education rather than undermining it. You acknowledge and agree that:

• You are solely responsible for how you use the answers and information provided by the Service
• Using InstantIQ on graded exams or assessments may violate your school's academic integrity policies
• We recommend using the Service only for practice problems, homework help, and studying
• InstantIQ is not responsible for any academic consequences resulting from your use of the Service
• Educational institutions have the right to prohibit or restrict use of AI tools

7. Intellectual Property

7.1 Our Rights

The Service, including all software, designs, text, graphics, logos, and other content (excluding user-submitted content), is owned by InstantIQ and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

When you submit questions or content to the Service, you retain ownership of that content. However, you grant InstantIQ a worldwide, non-exclusive, royalty-free license to use, process, and store your content solely for the purpose of providing and improving the Service. We may use aggregated, anonymized data for analytics and service improvements.

8. AI-Generated Content and Accuracy

InstantIQ uses artificial intelligence to generate responses. While we strive for accuracy, you acknowledge that:

• AI-generated answers may contain errors, inaccuracies, or incomplete information
• Answers should be independently verified before relying on them for important decisions
• We do not guarantee 100% accuracy despite our quality assurance efforts
• You use AI-generated content at your own risk
• InstantIQ is not liable for any consequences resulting from incorrect or misleading AI responses

9. Disclaimers and Limitation of Liability

9.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSTANTIQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers or your personal information
• Any errors, mistakes, or inaccuracies in AI-generated content
• Academic consequences resulting from use of the Service
• Any other matter relating to the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO INSTANTIQ IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including if:

• You violate these Terms or our Acceptable Use Policy
• Your account shows signs of fraudulent or abusive activity
• Required by law or regulatory authorities
• We discontinue the Service or specific features

Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination will continue to apply, including intellectual property provisions, disclaimers, and limitations of liability.

11. Privacy

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you agree to our Privacy Policy.

12. Changes to These Terms

• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

• Assignment: You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
• No Third-Party Beneficiaries: These Terms do not create any third-party beneficiary rights.
